Can I get any compensation in a DV case

in DVC am asking maintenance and return to my money and properties as well as compensastion.what is the meaning of compensaston,when he is giving to me.i.e it goes through the divorce ???? because am not interest to take divorce to him...please help me. In Mc ,how to file enhancement and salary attachment to my husband as well medical benifits..how am i getting these in this court..my children are minors and both are daughters this is the cause to left my life .how am i protect my self and child's care. please help me ...........

You filed DVC and MC case you have kids and you don't want divorce so better in MC ask Honourable Judge for Counseling and try to get the settled mutually which leads your happy marital life and your future too...

Answer: (1) compensation means an amount for causing you damages and injury. the compensation in DVC case is dealt in DVC case itself and not through the divorce.

(2) if there is a divorce petition filed by the husband then you have to fight hard other wise he will succeed and in the event if the divorce is granted then the whole DVC cases will be collapsed and you will have to forget about maintenance and compensation also.

(3) In MC case you can file a petition for maintenance and MC and DVC cases cannot go together as per latest Supreme Court order, only DVC is maintainable and not MC.

(4) you can get all reliefs including residence, medical and monetary benefits in DVC cases, and enhancement also, so dont worry, you only have to fight out through a competent lawyer.

what is the meaning of compensation in dvc act:-the respondent to pay compensation and damages for the injuries, including mental torture and emotional distress, caused by the acts of domestic violence committed by that respondent.
in dvc you may get interim maintenance for you and your children.

and in m.c how to file enhancement?
A:- M.C 125 crpc, if u got orders in interim or final order .after that you may file petition for enhancement or appeal.
