Can I file Harrasment case against my brother in law's wife
02-Jun-2025 (In Family Law)
My brother in law's wife file FIR against her husband and husband'sis and sis husband also so she had file false FIR against us and harras in every hearing because her father is sarpanch of this village so can I file case against her in Nagpur.
If the FIR filed by your brother-in-law’s wife is false and intended to harass, you can approach the High Court under Section 482 CrPC to quash the FIR. Additionally, you may file a counter-case for defamation, criminal intimidation, or misuse of legal process. If the harassment is continuous during court hearings and influenced due to her father being a Sarpanch, you can also request a transfer of the case to another jurisdiction like Nagpur for a fair trial.
If the FIR filed against you is false and intended to harass you due to local influence, you absolutely have legal remedies. You can approach the High Court for quashing of the FIR, file a complaint against her for false allegations and defamation, and even claim compensation for mental harassment. We can also explore getting the matter transferred if you're being targeted during court hearings.
