Can I file a case against step mother for property

I'm a Hindu orphan woman got married in 2006 when I was 18 only. After 4 years of my marriage my husband and in-laws they started torture me.Husband beat me and always threatened me to leave his home. I have child and he is 9 years old.Now I have filed a case against him and court has ordered him to give maintenance. But sir where do I live now my child is also live him.My step mother abandoned me already when I was just 3 years old my maternal aunt took care of me. My grandfather has died but after my father's death. So can I file a case against my step mother for property if yes then what are the chances that case will be in my favour. Kindly help sir.

Yes, you can claim shaRe fRom uR fatheRs pRopeRty, you aRe the legal heiR of youR fatheR's pRopeRty, this is youR vested Right, no body can abolish youR Right, Hindu succession act pRovides you this Right, no matteR if youR fatheR got maRRiage again, this wouldn't affect youR Right.

yes you can file case against your step mother in case you have ancestral property or earned by your father. The facts of every case has its own merits. further details are necessary for a better opinion.

You have full right on the property of your father and step mother which they acquire from ancestors. You need to make a list of properties . You have right in all properties of your father also for which no will is executed by him.
