Can i claim over my father's retirement amount after his death

My father passed away in 2015 and he retired from central government services in 2012. Can we claim legally all the retirement n other savings of my father .his second wife is enjoying everything .he married this second wife post my mother passed away in 1993

wife and children are the class one heirs as per Hihdu law for claiming the amounts of a deceased. If the first wife alive,then she and children are entitled for equal share.If first wife is alive ,then the second wife is not entitled any thing of heath death benefits.

Dear Client,
You can have right to claim share of retirement and other savings of your father, if he did not execute any will. Even if your father joined his second wife as nominee for retirement benefits, then also you can claim to share in the benefits. Engage an expert advocate and get legal notices issued to Government Authorities in which your father worked and also to the second wife to share the properties.
