17-Oct-2023 (In Family Law)
I m 26 yr old female. I was married in 4 Dec 2015. Everything was ok in the start by after 3 months his mother started insulting me she used to pushed me. They don't let go out and they don't let me go my parents house also. I have to do all the work in the house and she used to taunts me in every single minute. Things was getting worse . I spoke to my husband bt he didn't respond. In March i requested him that I wanna meet my parents please let me go for one after few days he said ok n I came to my home and after he never come to take back whenever I used to call him he told that My parents don't want you to come. My husband and his family humiliated me. I was having an affair before marriage and husband also knows about that and now he is blackmailing about that. Now he is telling everyone that I was having an affair after marriage. I wanted to know if he files for the divorce against this . Dis he get the divorce. And is there any law that can save me from this.

Hello mam
You don't tell that how your husband know about your affair whether he has any photographs or videos or any other proof and when he get in knowledge about this and after his knowledge whether you stay with him or not. Also tell now what is your stand whether you want to join him or you also want divorce.

Hello. The answer to your question is negative. He can't divorce you for whatever had been there prior to marriage. You've rights under various laws and you can approach court for enforcement of the same. Better to hire a lawyer and fight for your rights.

I read your query and the answer is your husband can't take divorce from you on the basis of previous relationship and you have other remedies also which is available to you when you will adopt the proper course of law.

He can file divorce petition not on ground of affair but on cruelty but he won't get divorce on that. It is very difficult to prove in court that you having affair amounts to cruelty. There is so much for your defence. Rest can be discussed
