Can anybody cancel the patta that was done in the land office

Hi, My father has 2 wives and 3 children. 1st wife has 1 girl and 2nd wife has 1 girl and 1 boy. I am the daughter of his first wife. My dad transfered 2 acers of land to his 2 nd wife son and it was registered(gift deed) and done the patta and mutuation. Now can we claim the share from that property or can we cancel that patta. Pease explain whom i need to approach. Please advise. Thank you! Regards, Madhu S

Hello mam first thing if ur father is alive u cannot claim for your share in that property
If ur father has expired then you have right to claim your share in your father property you can file a suit for partition

Hi
Since a gift deed has been executed by your father, you should be pleading undue influence and coercion as grounds for cancellation of gift deed.
Also if the property transferred is ancestral in nature, then you can claim a share of property and also annul the gift deed as null and void.

you are the first wife daughter, as per the Hindu costumes first wife is absolute rights of the property. hence you are entitled property of your father, but your father has already property was delivered in favor of his second wife son through gift deed. therefore now you can file suit for partition.
