Can a Married Daughter claim share in Ancestral properties.

HI,  My Father expired on November 13-2014. I have one elder brother, Iam the daughter. I got married on 2002 , that time, My father has given very less dowry. My Father has ancestral properties. After my grand parents expired, My Father has regiested the properties on his name. Now, Can i eligible to claim my ancestral properties. Thanks & Regards,

As you said that the properties are registered on your father's name, you are eligible to claim your share in the property along with your elder brother and your mother if she is alive. Feel free to contact me if you need any further clarification.

Dear Client,
What is the nature of the property. Whether your grandfather`s own property or he got from his forefathers. If it is purchased from his hard earned money, then it will be treated as his self acquired. Then, whether has he executed any will in your father`s name. How many sons and daughters he has. Whether your father is the only son or any other co sharers are there. You must furnish full particulars before seeking advice. If it is your grand father`s forefathers` property, then all will get share in the property. Your father, your brother and you, even though you got married get share. If it is your grand father`s self acquired property and he died without executing will or disposing off his property, even in that situation also you will get share. But quantum of share will be varied depending upon situation. You must have expert legal advise. Select one of the best legal advisers and take advise. If you got share, get a legal notice issued through him.

The Married daughter have equal right in the parental property after the advent of amendment in Hindu Succession Act 1956, that came into force since 9th Sep 2005. Dowry is not a matter here. You may ask your brother for share of the property. Else you may go legally.
