Can a defendant in impugned order bring contempt against other defenda

07-Sep-2023 (In Family Law)
An order was passed by High Court against two defendants regarding payment of maintenance to their aged mother. One defendant did not make full payment , as a result the other defendant had to make the payments (hospital bills etc). Mother is no more. Is a contempt petition filed by one defendant (who paid the bills of the mother) against the other defendant (who did not pay the bill of the mother) maintainable?

if the order has been passed by the High court then it has to be followed and any discrepancy with the court order will result in contempt of court for which a case can be filed. though it requires a lot of proof to be established but it is advisable that one should go ahead with the contempt of court peoceedings

It will depend with the other party had the wherewithal to provide for the bills. In the event they are able to prove that they did not have enough money to provide for the mother despite courts Order then it can be argued on the same basis.
