Dear Sir/ Ma'am, I've 2 questions for my understanding. 1. Ex-parte Order and Defense: If the defendant appears after an ex-parte order and requests to defend the case, can they present their defense in the current District Court proceedings, or must a new case be filed in a higher court? 2. Witness Presentation: What steps should be taken to properly present witnesses to support the plaintiff's case and secure a favorable judgment, including preparation and adherence to court timelines?

Dear client, Ex-parte Order and Defense: If a defendant appears after an ex-parte order, they can file an application under Order IX Rule 13 of CPC to set aside the order by showing a valid reason for their absence. If denied, an appeal can be filed in a higher court. 2. Witness Presentation: To ensure effective witness testimony, proper preparation is key—this includes examining relevant documents, structuring witness statements clearly, ensuring witness availability, and adhering to the court schedule. An Ex parte order in an ongoing case can be dealt with by filing recall application. Depends on the stage of the case. Witness presentation is something your advocate shall take care of. It requires multiple preparation including but not limited to preparation for chief and cross examination. Timely presence in the court, etc.
