Brother taken property not giving share

I have a elder brother. He has taken some money from me thither and made a big house and now he is not returning me my money otherwise the part of the land to. He has taken my shop from me by signing some papers by cheating me. And my Mother, Both sisters, Father, middling brother and other paternal and maternal family members are also helping him. They have totally looted me. Please help me.

You will have to gather all the evidences of the transaction between you and your brother involving the transfer of money and the reason for doing so. For recovery of money you will have to file a recovery suit in Debt recovery tribunal. However, to claim your share into the property you will have to look into the nature of the property as whether it is an ancestral property or self-acquired property. If it is an ancestral property then, you can file a partition suit in the civil court having jurisdiction over the area where property is situated for the purpose of claiming your share in the property. If it is a self-acquired property of your father then, he will have all the rights of transferring the property to whoever he wants.

Dear sir
If this Is a case of cheating with you by fraudalently signing on documents and papers you can file a police complaint and If the case is not going to be registered then you have right to file private complaint for cheating in court as well.

If all the chances of reconciliation have been exhausted, then

You can file a Police complaint against your elder brother for cheating you and also a Civil Case against him challenging his title to the shop.

For not returning money, you can file a Civil Case against him for not giving your money back.
