Black mailing/ Harassment By Woman

Around 15 yr ago I had accidentally sent a sexual message to a girl (text was..I want to sex with you). I had taken alcohol on that day. next day I sent text message "I am sorry, I was drunk). After that nothing happened. But at present date she is threatening me with that message. She live below my flat. As neighbours we have disputes over many things. Her parents always pressurize me. One week before she with her brother came to my house, she said I will defame you , file case on you and will beat you. Her brother said that he will break my legs and hand. With many sources I came to know that her brother is drug addict. Also she and her parents has been charged with atrocity case. They claim that they won the case. Can she file a case against me for texting her 15 yr before? What should I do? I am married , i am in stress.

A 15-year-old single message, already apologized for, is time-barred and unlikely to sustain a case. Threats amount to criminal intimidation. Preserve evidence, avoid contact, and file a police complaint if threats continue. Her Case will get dismissed from Court, but you cannot stop her from approaching Police Station and Court.

A single message sent about 15 years ago, followed by an apology and no further communication, generally does not create a sustainable criminal case today, especially due to delay, absence of continuing conduct, and lack of fresh evidence. However, the present threats given by the girl and her brother amount to criminal intimidation. You should immediately keep records of any threats (audio/video/messages) and submit a written complaint to the local police station seeking preventive action. If harassment continues, you may also file a non-cognizable complaint or approach the Magistrate for protection and appropriate legal directions. Do not engage in arguments and communicate only in writing if required.
