Ancestral land distribution by uncle do I have legal right to stop it

30-Jun-2023 (In Family Law)
My father has got some land by ancestors along with his 5 brothers. The land is registered on my Grandfather's name. Now, they want to share among each other but I have some problem. Can I file a case against my uncle? Do I have right on that land?

Yes you can file case of partition.. Being coparcenar you have birth right in ancestors property. If you have any problems with the division of property then you should file the case. And in the case of partition everyone is petitioner no one is respondent so you need file case against all.

The rights of a person in any ancestral property depends upon the extent of rights conferred upon him by birth. Therefore in your case your rights would be limited only to the share of your father if any contract of contrary is not present. You can file a case against your uncles to that extent.
