Adoption of a child with the father alive and missing mother

Can I adopt a child which is right now my younger brother's kid but the biological mother is said to be missing by the biological father of the child after 4 to 6 months of chilld's birth. The biological father is abusive towards the child along with his current wife. There are approxinately 5 marriage certificates of the biological father of child but no divorce ones. The child lives with me and my family since the mother went missing he wants to live with us. Can I adopt him?
