Harassing senior citizens and other family members

My elder brother recently got married. But after few days her wife harassing our family including me younger brother and our parents who are senior citizens. Also she is threatning that she will put false dowry case on my family and later will divorce my brother to get the alimony. What is the solution for this? My house is registered in the name of my mother Can she claim her rights in our house ? Is there any way we can rid off from this false threatning

Dear querist, Indeed there is a way. If your sister in law is some way or the other harassing your parents. The best remedy in such situation is filing a petition under senior citizens act and get the eviction order of your sister in law. This will make sure that your parents who are senior citizens are not harassed anyhow. Apart from that your parents they will be given protection order. Coming to your another query: No, she cant claim the right as to ownership in your family but she can approach the court for residential order as it is her matrimonial home. But there are ways to deal with such situations. Apart from that we also have to think about the safeguard of your and your brother interest also which can be figured out at a later stage.

Yes, you can lodge a complaint in Mahila Thana of your jurisdiction or CAW cell regarding the issue, also try to collect the evidence's from now on like record her phone calls where she is treating or record the arguments at home where she is threatening you guy's, you and your mother can also file a domestic violence case against her. No she can not claim her right in the property which is on your mother's name and there are various preventive steps you can take.

i can certainly understand th problems your family is good ng through these rough days of lockdown. but let me tell you, we are there for any legal help whatsoever is needed.
