Domestic Violence And Monetary Reliefs

My wife has filed dv case and claimed monetary reliefs and first hearing is fixed at 23rd Aug 2023. I am presently employed with IBM with net monthly income of Rs 74, 000. Last year in March 2022 I was posted in United Kingdom on short term deputation due to business requirements which is going to end in next 6 months i.e Jan 2024, so I am getting additional deputation and living allowance of 2500 GBP. My UK expenses are around 2500 GBP.I have 2 dependants in India and I am paying the rent for their rented accomodation in India around 35k and also paying them 25k for their groceries and other expenses. My wife has declared in her case that she is earning 60k every month and she is staying in her parental home which is ancestral property where she has a share. . My only question will court consider by India take home net salary as I am a permanent employ of IBM India and posted on short term deputation or the entire deputation allowance and India salary both.

Since your wife is also earning a decent salary then obviously that fact will be taken into consideration. And also both of you need to file your income affidavit on the next date of hearing which will reflect everything regarding your salary and all. But if you are willing to stay with her then you should file a petition under section 9 HMA for calling back your partner in your matrimonial life. For more legal assistance I am just a call away.

You need to submit income assert liabilities expenditure form so does your wife with last three years income tax return ! I need to hire expert advocate to peruse your case !
