What to do if possession is delayed and post dated cheque is given
28-Dec-2023 (In Documentation Law)
Hi we have mentioned a post dated cheque number in the absolute sale deed and purchased a property, however there was delay in completion so the post dated cheque has become stale. Do we have to create a rectification deed if a different cheque is issued at a later date.
Question is very vague
It is not clear as to who executed the sale deed to whom
Whether it is already registered or not
Who issued cheque to whom and what amount
What is the sale consideration
Whether it was for the full sale consideration or part payment
Whether possession is delivered to buyer
In the absence of detailed information it is not possible to express any opinion much less legal opinion
