Dear Client,
A GPA is not a compulsorily registrable document. However, it has to be stamped adequately to ensure it is enforceable and admissible as evidence in a court of law in case of a dispute between the parties. To register a GPA, the stamp duty payable will be as per the State's Stamp Act along with the registration fee. In case a GPA has been given for consideration, the stamp duty applicable is the same as the stamp duty payable on the sale deed of the property and is based on the market value of the property. In case of a GPA in favour of a family member (father, mother, husband, son, daughter, brother and sister), for sale of a property in Karnataka, the stamp duty applicable is Rs 100. In case a SPA is executed by the owner of a property in favour of one or more persons, conferring the power to present documents executed by the owner before registration authorities, it is compulsorily registrable. The stamp duty payable is Rs 200 and the registration fee is Rs 100. You must consult Registrar and it varies from case to case.
