Validity of agreement with taxi driver for any future responsibility

I found that my driver who is driving my commercial taxi vehicle(Indica Car), is giving the car sometime to his relative to drive for him without my knowledge who is not having a valid license to drive. Currently i can't change him until i got another guy. So if i made a agreement with him that for any future consequences he will be responsible for an year duration, will it be a valid one according to law? will it save me in case that another driver made any traffic/accident issues?
There is presumed employer employee relation between you and driver appointed by you. In case of any miss happening you will be vicariously responsible for the same. The acts done by driver in the course of business will deemed to be your act . In case he acts outside the scope of his job than you wont be responsible.
