Use of national ashoka as profile picture legal or not

Hi Is it unlawful to use Ashoka as profile picture. As a commissioned officer if i can wear it on my shoulders and cap how is it that i cannot show my profile picture.

As commissioned officer, under the law you have privilege to wear national emblem being a soldier of the country. You have privilege to wear it on your shoulder by virtue of your official capacity, while you are on duty and not otherwise. You are not supposed to wear it while during your personal time. Once you wear national Emblem you represent Govt of India. Now you use profile picture in personal capacity on social media or on any such similar platform. You do not represent govt of India on such platform, so you may not be allowed to use national emblem. Even when you have to be identified in official capacity you have show your identity, and may not be allowed to use national emblem to identify yourself.
