Unregistered Flat, stamp duty paid. How to resale without penalties?

Hi Team, I have an aunt who wants to sell her flat in Thane. She is a widower and now the issue is flat still reflects in the name of my uncle and while buying it he didn't register but the stamp duty was paid. The customer who is willingly to buy is facing issue to get a loan in reputed bank. Now the lawyer says its a big problem you have do deed of confirmation and get the registration done and pay the penalty issued by the judge which may go around 50-80k. She is in a dilemma and needs some solution. Share certificate of society is in my aunts name. Regards, Roshan

In the given situation, your aunt will have to obtain a death certificate, thereafter she will have to transfer the title of the property in her name and thereafter if she faces any issues regarding the title of the property then she can file a declaration suit in the jurisdictional civil court along with all the documents supporting her claim over the property
