Procedure to get death certificate of father

Hi my father had left me and my family when i was 5 years old... I'm 22 years old now...We tried searching him but we were failed to find him as his whereabouts where unknown...since our family properties are in my Father's possession..we are unable to get any benefits using our properties...so we are thinking about getting his Death certificate to change his possession to our name as his whereabouts are unknown until now...please tell me if there ways i can get Death certificate...

In this case as you mentioned here that your father is missing from more than 22 years,as per the law your father is not dead in the eye of law.you have only the way to file a petition in the high court and take some proper directions from the honurable court,this is the only way.

First file a complaint of missing with the local police and take acknowledgement for the same
Give a paper publication about missing with his photo
Wait for some reasonable time
Then a suit for declaration that he is dead
Court on being satisfied about your evidence, if convincing, would pass a decree
Using that judgment and decree get mutation in revenue records

Any person who is missing, absconding or not be found for more than 7 years is deemed or presumed to be dead in India. You have to file a Declaration suit in the jurisdictional Civil Court praying for declaring your father to be dead. Accordingly, you will be issued a Death Certificate as per the said Decree. Subsequent to such an order, all the moveable and immovable properties in the name of your father will be open for inheritance equally by your mother and your other sibling including you.
