Occupancy and completion certificates not given.What can I do?

I had bought a flat in Annapurna society in Nagpur around 1 year back and have been living there since then. I am getting the property tax bill and water bill regularly but the developer has not given me the OC. Kindly guide me regarding the options available if any, to get the Occupancy certificate.

There must be some date mentioned in the property papers by which the builder is required to give you occupancy certificate. If that date is there, talk about this to your builder. If it is being delayed deliberately without any reason, you must send him a legal notice, about his interest in delaying the occupancy certificate. You may also approach the concerned local civic body office as a Group, and apply for OC.

An occupancy or possession certificate and completion certificate are mandatory certificates that the builder of any flats needs to obtain after completion of the said building.  As per certain state laws, one cannot legally move into a building unless the developer gets an occupancy certificate from the respective local administrative or civic bodies. The legal possession of the flat by the owner is valid only with the occupancy certificate. The corporation or municipality can ask the apartment owners to leave such illegally occupied flats or impose heavy penalties in the name of ‘regularization’.
