Merger of company issue in allotting name

our company name is granted by NCLT is being challenged after the scheme of merger whereby one of our company being merged into another and applied for name change as the 2nd one. NCLT now appeals that this name cant be granted as it is similar to the 2nd company's name. But the name is being already granted so why to challenge now

Name once granted by NCLT generally is not revocable even if it is similar to the name of the transferee/transferor company. Also, if the contract of the merger, provides for the same then it will be as per the contract/agreement between both the parties.
