If holder is not aware of issuers death can he make use of POA

19-Feb-2023 (In Documentation Law)

Will highly appreciate if someone can suggest that "Power of Attorney" what every kind it may be according to Gujarat or Indian law is it invalid after the issuers death. Can the holder not being aware of the issuers death make use of this PA and claim it to be valid as he was not aware of the issuers death. ?

Any acts done by the attorney holder after the death of the person who has given the power are invalid. They may even amount to fraud and cheating if the attorney holder was aware of the death of such person. As a general principal, an attorney holder or agent cannot go beyond the person giving the power. Feel free to get in touch with the LawRato team at 9599-000-555 for further assistance.
