How to get a new passport made

I have lost my Passport and for that I have registered a complain with the Chandanagar police station (Hyderabad). Along with the complain have provided an affidavit to support the complain . It has been nearly a month but the police is neither giving me a FIR copy nor a lost certificate. When ever I go to the police station the chief officer of the station insults me and tell that I have lodged a false complain, he even uses words like "you are telling a lie I will kick you" and treats me as if I am a criminal. Please suggest what can I do legally, the passport was issued in Kolkata and it was lost in Hyderabad

the police try to avoid registering an FIR in respect of a stolen passport. This is because it casts on them a duty to trace and find out your passport and if they fail to do so , the same is deemed to be an in efficiency of the police officer as to why your passport has not been recovered and the thief caught. During inspection by senior officers of the police the pending cases are noted and remarks posted which credit or dis credit the police officer in charge.

In case of lost passport, the police has no onus of finding and tracing the same as it has been lost and there is no chance of finding it.

It is either you who has misunderstood or the police has erred in informing you.

Write an application addressed to the head of the police station and state therein that you have lost or misplaced the passport in .. Place and have not been able to find it inspite of your best efforts. That you will inform the police station in case you find the said passport and will not misuse he same if found. An affidavit in support of the application is attached herewith. Further write that an FIR in this respect be registered.

Along with the said application get an affidavit printed/ typed in support of the above application.

Take these documents to the police officer in charge of the concerned police station and apprise him of the matter. Don't contact any subordinate.

He will understand and get your FIR registered and a copy of the same will be supplied to you.

In case he refuses to help you , you should go to the office of the Senior Superintendent of police of your area and narrate the facts before him and request him to direct the SHO of the police station to lodge the FIR and issue a copy of the same to you.

If you opt you may meet the DSP , SP in charge before going to the SSP.

They are senior officers and understand the problems of the public at large and they do help.

In case none of the above methods sort out your problem then in such a case I advise you to approach the judicial court of your area under which the concerned police station falls and a very simple suit is to be filed stating that you have lost your passport number . Issued to you by . and state where you have lost the same.

Inform therein that the police head of police station. Had been approached and but he has refused to entertain your application and has not lodged the FIR inspire of your best efforts. Pray therein that the said SHO be directed to register the FIR and issue a copy of the same to you. The judicial officer should pass the order at the earliest and I am of the opinion that he would rather opt to direct the SHO to lodge the FIR rather than add and bear the unnecessary burden of a frivolous and petty case pending before him.

I feel that the step of resorting to the judicial court will not arise.
