How can i get married to a girl whose earlier marriage is registered

I want to marry a girl who had earlier performed marriage in her college days with a guy in a temple. After this marriage in temple both of them have signed a notary that they married in temple. but the notary does not have any witness sign. Now she also want to marry me and families are also in favor of our marriage. However the guy is not willing to let her go. Please suggest me how can i go for marriage.

According to the Hindu marriage act If the marriage was solemnized as per rites and rituals then, even if it was not registered it is a valid marriage in the eye of law and notarization of marriage is not valid according to the Indian law. If the girl wants to marry you again then she has to approach the court of law in order to get a divorce for her previous marriage. Remarriage without taking divorce is illegal and the second marriage is no marriage in the eyes of law also the person may be prosecuted for bigamy. So, it is very necessary to first legally dissolve the marriage and then think of remarriage.
