As it is a criminal offence, the person who is caught for the said offences will tried as per the procedure of law. However, the court will order an investigation regarding the same. Though, after filing a FIR for the same the police will start a preliminary investigation to find out both the offenders. And if the police is still unable to get hold of the other accused, they may pursue him for disclosing the other person's name. If he does not provide the name then, he will be charged for the same.
