Arms licence for defence personnel

04-Jul-2024 (In Documentation Law)
Sir I am serving in the Army and I am about to retire this year. I wanted to know the procedure to apply for arms licence for defence personnel in Mumbai for resettlement as an armed guard. Also is it possible to transfer an existing license and rifle of one of my fellow serviceman in my name as he does not require the same.

In India, defense personnel must apply for an arms license for personal firearms, though they enjoy certain advantages such as automatic eligibility justification and the possibility of an All-India Validity (AIV) license. Serving personnel do not need a license for service-issued weapons, but personal firearms require approval. The application process involves registering on the NDAL-ALIS portal, submitting Form A-1 with personal details, uploading supporting documents, and submitting signed copies to the relevant licensing authority. Key documents include a posting-cum-residence certificate, retirement orders for retired personnel, a No Objection Certificate (NOC), proof of identity and residence, medical fitness certificate, and an undertaking for safe firearm use.
Yes, it is possible to transfer an existing arms license and rifle of one of your fellow servicemen in your name, subject to the following conditions:

  1. Eligibility: You need to be eligible to hold an arms license and possess a firearm as per the Indian Arms Act, 1959. This includes being a citizen of India, at least 21 years old, and having a clean criminal record.

  2. No Objection Certificate (NOC): The first step is to obtain a No Objection Certificate (NOC) from your local police station, stating that they have no objection to the transfer of the arms license and firearm.

  3. Application: The application for transfer of arms license and firearm should be made in the prescribed format and submitted to the licensing authority, along with the NOC, original arms license, and other relevant documents.

  4. Verification: The licensing authority will conduct a verification process, which includes a background check and physical verification of the firearm.

  5. Transfer of license: Upon successful completion of the verification process, the licensing authority may transfer the arms license and firearm to your name, subject to payment of applicable fees and compliance with all other requirements.

It's important to note that the transfer of arms license and firearm is a complex legal process, and you may require the assistance of a lawyer or a licensed arms dealer to ensure that all legal formalities are completed correctly. Additionally, the licensing authority may impose certain conditions and restrictions on the transfer, such as the type of firearm that can be transferred and the location where it can be stored.

sir there are several different types of arms as your are aware. Arms are classified into types and we require to know the purpose for which a person is applying for the licences. after retirement your status will change from serving army officers to retiree therefore the class of weapons that you may or may not apply for licenses also changes. I will require to make enquiries which will involve documentation. if you wish I can do this for you. however i will require you to meet me.
