Bequeathing property by Will wife sold the property

24-Feb-2023 (In Documentation Law)

Father purchased the property in the name of his minor son. After attaining the majority the son fell ill and bequeathed all his property including the property purchased by his father to his wife. The wife sold away the property to some one. Can she do so. The will is not available with sale deed, the date of will is also not mentioned. The property is not self acquired by the son. Please give me advise to purchase the said property.

As the property was acquired by the father he has to prove so but due to lapse of time and the son attained the majority age the son has absolute right of the property and can transfer and sell the property according to his wish. He can transferring his property to his wife through his will is valid and she has the right to dispose off the property the way she wish to.
