Working in abroad wife filed case in women cell what should I do

Dear sir, I am married to my wife since9 years and i have son of 7 years. Since 2.5 yearsi am working aborad now before i camback my wife left hpuse now i am back she fiked women cell motice to me. Also i want divorce now from her so what i do know. Second my job is abroad and i want to work abroad even if she go 498a or crpc125 act. So i women cell does not resolve issue whats next she can do. Can she stop me to work aborad and i can't work anywhere. Please give me what next step fir safety.

You have to be careful, n represent through a family member at woman cell and through lawyer in maintenace petition under section 125 CrPC. You can continue working abroad n defend the cases however, you need strong n regular representation in court and authorities.

No you cannot be stopped from working abroad. you need to file a case for divorce causing cruelty to you.. fortunately as it is more than 7 years ie, to be precise nine years of marriage applicability of Section 498A IPC wont be there. for 125 crpc you have to contest.. by the way the custody of child is with whom and who is taking care of his expenses..

try to resolve issue in women cell. they too have mediation centres where you can amicably resolve... first try to find out whether both of you are interested in divorce, the same may be worked out mutually.

If you want to divorce her. You have to send a legal notice in this regard. You have also to appoint an attorney who can appear on your behalf in the court. You have to appear before the court only for two times. Firstly when the court directs the separation for six months and thereafter you have to come to sign second and final motion of divorce. If your wife is working she can not claim maintenance but if she does not she has the right to take maintenance. It vary on case to case. She may ask a lump sum amount or a monthly expenses. Choice is yours. Revert me . All the best.
