Withdrawal of case in the presence of a stay order

19-Jan-2024 (In Divorce Law)
My husband had filed a GWOP and RCR case.... He filed both cases in jalna... I live in hyderabad with my son... So we got stay order first then we sought to transfer the case to hyderabad...now a settlement is being made in which he has to withdraw both cases... Can he withdraw in the presence of a stay order or should the stay order be canceled first

Yes, your Husband can certainly get the two cases withdrawn by him from such courts, where you have got the cases transferred, i.e, in Hyderabad, after he had filed the cases in Jalna. Yes, he can withdraw during the due existence of stay order on due continuation of proceedings in Jalna.
