Will the judgements of 498a and Mutual Divorce be treated as one?

20-Sep-2024 (In Divorce Law)
I am ready with 70% of the agreed alimony money. The remaining takes time. Can i pay the 70% to file and get MCD first and attach the remaining to the 498a case? My reasoning behind this is - MCD will be faster if we waive the 6 month waiver. Removal of 498a takes time. So treating these two cases differently will save time. Is this legally valid? Or is there a chance that i will not be granted the divorce since there are pending issues? What are my risks if i go down this path?

Dear Sir, It all depends upon the decision of your wife. If she agreed for MCD with seventy percent of alimony then you can pay the same and get divorce with a condition that you will pay the same after six months or so. Till then let criminal Case pending. Whenever you pay the balance then get close the Criminal Case and accordingly condition will be satisfied or mutual divorce case maybe kept pending.
