Will remarrying without divorce decree be amount to bigamy ?

27-Jan-2023 (In Divorce Law)
Me and my husband decided to get divorced on mutual consent. We signed the divorce agreement on a 500 Rs stamp paper. He got remarried before submitting these documents in the court. He later on sent me a notice for getting the decree. The case is still in the court. Can I take any legal action against him? Can this be considered as a bigamy ?

first your husband can not get remarried without divorce with u, if your divorce still not done, and court procudure still remain then u are legally wife of your husband. court will give u time of 5 months, u have to complete that duration and then magistret give u legally divorce order. this is procudure, yes u can tace all legal actions against your husband u have all rights, b.cos u are stilll wife of your husband.

Dear
Until and unless the court cannot grant the divorcee decree there is no separation so it is a one type of bygamy. You can demand more in separation application for maintenance. In no of cast it is valid that divorcee deed was made on 500 Stamp paper and then file divorce petition way back.

Thanks.

It's depend upon your cast, if there is rites that gays and and wife can divorce on stamp paper then it doesn't call bigamy.
It may be your husband file a case for declaration on divorce deed form court.

In Hindu religion a married person without getting divorce cannot remarry. You may file a case and plead ignorance about the consent divorce agreement. You can also withdraw your consent before COURT order.
