Q: Procedure to claim maintenance from wife

My wife Working As A Civil Judge in Trial Court.. I was taking care of our Daughter and Her since Her Job Started in 2012. She Throw me out over past misunderstandings in April 2017 from her residence. Now she is sending threats for Mutual Divorce or She Will File 498 DV Dowery Cases and Put me In a Jail. We did Intercast Love Marriage in 2005. Baby Girl Born in 2011. I am homeless and living on mercy of friends... May I get Maintaince till she files a Petition. ?? Pls Help

u need a good lawyer bcos your wife is civil judge. she has vary good pay, if she threats that if u not give her consine divorce then she put u in jail....now u have only 2 option..1.go to with some nice solution, consine divorce else498 case.long case, mainly, physically,and financially, big trouble, b.cos she know what is low, how can she give u trouble.go to with any trouble less solution.



Q: Wants to marry a girl parents threatening to claim money after divorce

I am 40 year old. I am in love with a girl of 21 year old. I am Jain by religion and she is hindu by religion. We decide to marry.We live in Ahmedabad and work in the same company. I will inherit my fathers bungalow which cost 1.5 crore. Girl's parent says they will ask the girl for divorce and extract divorce money from me which amount to 70-80 lakhs from property settlement. They are aware of property settlement in divorce. Should I marry the girl because there is risk of divorce and my property settlement money. I will not be willing to give divorce in any case after marriage as I will have to pay alimony and property settlement money. Can they force me to go for divorce whether it is mutual consent, uncontested or contested.

if u won't to get divorce with your current wife, then u have to accept all demand of her.and then u can file consine divorce pitision. after 6 month final order of civil court, u can marry with any girl.



Q: Will remarrying without divorce decree be amount to bigamy ?

Me and my husband decided to get divorced on mutual consent. We signed the divorce agreement on a 500 Rs stamp paper. He got remarried before submitting these documents in the court. He later on sent me a notice for getting the decree. The case is still in the court. Can I take any legal action against him? Can this be considered as a bigamy ?

first your husband can not get remarried without divorce with u, if your divorce still not done, and court procudure still remain then u are legally wife of your husband. court will give u time of 5 months, u have to complete that duration and then magistret give u legally divorce order. this is procudure, yes u can tace all legal actions against your husband u have all rights, b.cos u are stilll wife of your husband.
