Will i have to pay Child Support if i return to India permanently?

Hello Attorneys. Me and my Ex wife were married in Delhi in 2013 received our Divorce Certificate recently. I am still permanent resident of Canada and have been paying Child support on time without any failure. Question -: If I renounce my permanent resident status and return permanent to India (Because of mental and financial issues), can my ex-wife force me for Child support from Canada and make my pay. My son is 6 Years. Is there any Hague Convention with Canada.

hi all the court order given at forginer land has to be executed in india than only its valid in India. As I understand from you statement that maintenance of child has been fixed in Canada. if you come to india ur ex wife has to face so many legal issues to get maintenance and as per india law it can decrease also.

No you don’t want to pay child support money because you both are divorced now according to law you have to pay maintenance of wife and child till divorce or living in a separation. So first to all fix an appointment with an advocate who will provide you legal consultancy regarding your matter

Hi, Yes foreign judgements are enforced in India. Also does your ex wife work? If she works, does she earn enough to maintain a descent life? What is your current financial situation? Why has it gone bad? What has happened to your health which impacts your earning? I believe you can also approach the court for modification of order and can do it in India as well.
