Dear Client For a decree of maintenance, you need to file a case under section 125 Cr.P.C. it is not necessary for the judge while granting a decree of divorce ex party to include an amount as alimony. Generally at the time of mutual divorce, an amount if pre decided is paid as a one time settlement amounT. The divorce decree will be passed according to your pleadings before the court. In case, a prayer to that effect has been made, the judge may grant you relief. feel free to get in touch to discuss further.
