Wife`s mental disorder condition was concealed at the time of marriage

I got married on 22.1.17.Within a month after marriage my wife perpetrated extreme cruelty by her acts.She sometimes became abnormally aggressive & gave me so much mental & physical torture that I was unable to focus on my office work.She even threatened me to torture my parents if needed.On 17th March the situation was so severe that the local police was informed and they suggested to inform her parents.Immediately her parents & brother were informed.The very next day they came and took her to their native place. Before marriage ,the parents did not tell us about her psychopathic disorder.They even concealed that she was suffering from acute Type 2 diabetics which can cause blindness and fatal.Her increasing vision blurred was also hidden. Question is: Under the above circumstances,can my marriage be annulled as null and void on the ground of fraud and cheating & how to get divorce from her immediately ?Please advise.

Based on what you have explained, if you are able to get solid evidences (both before marriage and after marriage) you can file a petition for divorce seeking exemption from the 1 year mandatory waiting period and also if required file a complaint against her family members

Yes the marriage can be declared as null and void on ground of fraud and misrepresentation of facts, please remember the case has to be filed within one year so don't waste your time immediately file a petition in family court to declare the marriage as null and void.

It is also a void marriage. When there is a suppression of facts at the time of proposal and by misrepresentation the marriage was done, then it can be refereed as Void Marriage. On the behavioral attitude of your wife and when the marriage is not consummated in full, then such marriage be refereed as annulled as null and void on the ground of fraud and cheating.

You can try filing a Petition under Hindu Marriage Act on the ground of incurable disease but you need collect strong medical proof to prove your wife has got psychopathic disorder. You can file the divorce petition in Bangalore. I suggest you to contact a good Advocate in this regard. But plz remember normally under Hindu Marriage Act, at least one year has to elapse to file a divorce Petition. Only for marriage annulment you can file in rare cases.
