Wife taking my kid and staying in her parents house very often

Married since 4 years. Initially my wife insisted to stay in a separate house which I denied. So she left matrimonial home and stayed with her parents saying until I make a separate home she will not come. 6 months later she came back with her family and they left her saying she will not do any demand as such. Now we have a daughter of 2 years old. She finds some reasons each time and takes away kid and stays with her parents. Is there a legal way to handle this ?
Dear Sir,
You have to get issue a legal notice under section 9 of Hindu Marriage Act saying that she must return to the matrimonial house with child and stay continuously. Failing which clearly say that you are going to apply for divorce without any alimony and put an end to the marriage.
