Wife staying separate and filed a case of maintenance what to do

Sir/Madem My son got married on 24th Jan. 2015. He is Govt. Servant. His wife stayed with us less than 1 month at my place after the marriage. On 26th Feb. 2015 she went her father's home in Ghaziabad for Holi festival. Till then She stayed her parents home saying that she is doing coaching for PCS exam. My son and my family tried to contact more than ten times to communicate her. But she switched off her phone. Her Father became in touch on phone with me on 12th June 2015. With mutual telephonic consent he agreed for his daughter's Next Bidai to our home after completion of the coaching. But In the end of the 2015 she filed a case of 125 Crpc against my son, showing that she lived with my family more than six month. And she also demanded 20 lakhs and imposed false allegation of DV. I filed section 9 in pratapgarh Family Court. Now she again filed a case in Family court Ghaziabad and a notice have been served to my son for Divorce. We do not want divorce. Pl. Suggest.

You must engage a good lawyer of family law. You will have to fight divorce case on merit in Ghaziabad court. You will have to fight almost three cases I.e. 125, divorce and dv act. I advise you to consult a lawyer and take next steps. If you need I can help you.

She wants to divorce to your son but you don't want .you have to appear in divorce suit for protesting the petition otherwise it will be ordered exparte against your son.and along with you will have to continue your petition u/s 9 Hindu marriage

If your son's wife has filed a case for divorce and she doesn't want to live with him, then probably you do not have any other option but to contest the same. As it is she has filed for maintenance as well as cases under DV Act.
