Wife separated with two twin child at the age of 2 years. Case is on.

Age of childs are 4 years right now. Is there any way I may assume the custody of the childs.

The custody of a child is based on the best interest of the child. for any child below 7 years it is statutorily presumed that the mother can serve best interest of the child. but if conditions which are drastic in nature which can rebut the presumption then a case may lie for assuming the custody of the child for father.

generally when the age of child is above 5 years then the custody of child is given to father otherwise to mother but there are special grounds on which the custody of the child can be given to father rather than mother..

yes custody can be obtained upon a recent order from court where mother cannot only enjoy such right rather both will have equal rights and equal sharing and caring of child and it needs to be dealt properly for prime concern of children
