Wife not wiling to get back and stay with me. What should i do now?

Married in 1st June 2014. Immediately after marriage, the girl left the house and went to Chennai stating that she wanted to go for higher studies. She doesn't want to stay with me. I have tried all means to get her back. But there is no response to get her back. What can i do now?

If you are still interested in continuing your married life with her, you have to file a petition in the Family Court under Section 9 of the Hindu Marriage Act 1955 for Restitution of Conjugal Rights. However if you are not interested in continuing the marriage,you will have to file the case under Sec 13 of Hindu Marriage ACT FOR DIVORCE ON GROUND OF MENTAL AND PHYSICAL CRUELTY AND DESERTION.

Now the time has come that you have to decide if still you want to live with a self centered lady or you want to get rid of her and legally speaking wee can file a case for restitution and in the alternate we have to seek disollution of marriage by decree of divorce

Dear Sir, the facts stated by you show that your wife is unwilling to reside with you. So it would be inadvisable to move court to get decree directing your wife to live with you. What appears to be wise in this circumstance is that you should try to get divorce by mutual consent, if you could convince her as there is, apparently, nothing worth to carry burden of this formal relationship. The mutual consent divorce will save you from monetary burden on account of various claims by your wife.
