Wife Left home on argument and not coming back

Hi, me and my wife was having arguments after marriage and after 9 months of marriage, she left home and not coming back. I tried to her back but now started realizing that she will not return and may file for divorce. In that matter, a wife what are the ways by which she can harass me and trap me or my family member in legal or police matters like domestic violence to make her case strong. pls help to prepare.

Well, she can put a case of Sec 498A of IPC against you. She can lodge a Domestic Violence Case under the DV Act, 2005. She can put case to seek Maintenance from you under Sec 125 of the CRPC, 1973. She can also seek Maintenance under the DV Act, 2005.

If you feel that your wife is just trying to harass you and not return to resume married life or is intending to file for divorce then inorder to avoid future harassment from your wife in any manner then its better that you send her a legal notice to resume back with you. This will weaken every step that your wife might take in future.

She can seek mainntenance and alternative residence under D.V Act and of Cr.P.C. .for precaution , you may send a legal notice asking to rejoin matrimony and you may seek RCR under sec. 9 of HMA
