Wife left home 7 yrs back and filed false case in police need divorce

I am Sr Divisional engineer in railway. My wife left home 7 yrs back with child working in university living with parents take all items with help of police complained against me in railway. In police for kidnapping my son. I filed case on cruelty ground in 2011. Family court dismissed case filed appeal in high court. How i get divirce?
CRUELTY HAS NOT BEEN DEFINED NEITHER IN CIVIL OR MARRIAGE LAW. IT CAN BE BOTH PHYSICAL AND MENTAL CRUELTY. CONTEST THE CASE ON MERIT. IMPLICATING HUSBAND IN FALSE CASE OF KIDNAPPING CONSTITUTES A MENTAL CRUELTY.

First make it clear in which case you have went to high court.for divorce you had to apply to family court on basis of behavior of your wife and same has to be done to get the child custody.and if your wife is self dependent and earning fine then you can also file case to get relief in paying compensation to your wife
