Wife is living in matrimonial home husband has put contested never and husband is living in rented house after getting divorce will wife automaticly vacant the house or not

Wife has a right to reside in the matrimonial home. Even after divorce she can stay in the house unless you take steps to get the possession of the house. Feel free to contact me for seeking any legal advice/assistance as regards the same.

Divorce does not automatically require the wife to vacate the matrimonial home. Under Indian law, she has a right of residence in the shared household. She can be evicted only by a specific court order, depending on ownership, facts of the case, and any DV or maintenance proceedings.

legally she is bound to vacate the house but intentionally she will not do that so you must send her legal notice for that and mention clearly about home and judgment and give intimation of filling police complaint then she will permanently go from your life

She will not by itself vacate the house In case of mutual consent you can get it vacated on terms and conditions mutually agreed If the property is in joint Nema you can ask the court to sale the same or allow you to be in the house But in. All the cases you will have to give wife a rented house at least. Or in case of mutual consent a lumpsum compensation can be given to her and ask her to vacate the flat
