Wife having extramartial affair, can divorce be asked for on same?

I am Parsi.I am married in 2008. Since then my wife is having affairs She deleivered daughter in 2011 and 2017. later on I came to know that she was having affair with a office security guard Lahu Ganpat Chogule..She confessed verbally that he took her to Siddhivinayak temple at Prabhadevi, also they used to go to Dadar lodge for sex.She does not want to go for mutual divorce. At present she is at her parents place as I do not want her with me.I am earning Rs.8000 a month due to which I am not able to afford lawyers heavy fees.Kindly Advice me way for cheap divorce.(We had shifted to Vasai from 2010 to 2012 there too she used to go to others after I left for work.I do not have any proof in writing and she will turn hostile in court but if court orders DNA test the picture will be clear. Thank

Court can help you by providing legal aid and other legal help once you approach in a right manner.Also you can ask the new beginningners freshers in law for more options.Least you can get is the legal approach which will make your life a bit easier and smooth.

You can file for adultery against that man and file a cheating case on the wife if you have all the valid proofs and thereafter approach the hon'ble court for divorce and in the cheating case move an application for dna

Hi,

You can take divorce on ground of adultery under Parsi Marriage and Divorce Act u/s 32 (d) and also pray that since your income is low you cannot give her maintenance amount as she has forced you to file the divorce on ground of adultery committed by your wife.

it is very unfortunate that such incident took place with you. as per as your query is concern you do not have any other remedy instead to go in the court for divorce. as per as the cost is concern it depend on council to council. you may do one thing, make ready to your wife for divorce so that duration and cost will be saved.
