Wife has sent legal notice seeking maintenance what option do i have

Hello, I and my wife are separated since 2yrs and I have got one daughter! We didn't had any personal fights between us, her parents used to interrupt and make us fight! And now she is at her mother's place! I got a notice from family court stating that they are asking for maintainance for my daughter 25000 and for my wife 25000 rupees! I'm from middle class family, nor have any properties! What should I do now? File for divorce or for maintenance? And I'm ready to accept her but all they need is money from me! Thank you.

You give reply notice and say all the allegations made in the legal notices are wrong and give reply notice to her. when there is no issues between you and your wife then you can file Restitution of Conjugal rights in the court where you can say what had happened between u and your wife.

you have mentioned that you and your wife separated since 2 years .if your wife filed maintenance case,you have to contest the matter before the court. once you received the summons from court ,you have to appear before the court.otherwise court will pass order.if you are not interested to live with your wife ,you can file divorce

You should enter appearance in the said maintenance case and at the first hearing the court would send you for counselling. There you could try to convince her for reconciliation. For the question of maintenance , you should pay some money for your child and you could contest only on the question of quantum. As for as your wife is concerned if she is working you need not pay. Meanwhile you could file a petition for restitution of conjugal rights since you are ready to accept your wife.
