If her first marriage was valid and not legally dissolved, her marriage with you amounts to bigamy under Section 82 of the Bharatiya Nyaya Sanhita, 2023. You must prove both marriages and that the first subsisted at the time of the second. The FIR can support your case—file a complaint before the Magistrate.

You may file a complaint for bigamy, if you can prove that your wife married you without obtaining a legal divorce from her first husband and thAt you were not aware that marriage was not dissolved. The FIR copy mentioning her earlier marriage can support your case. However, if you were aware that her previous marriage was still valid and yet went ahead with your marriage, your complaint may not stand, and you could also face legal action. It’s advisable to have all related documents reviewed carefully before taking further steps.

Yes, you can certainly file a Bigamy Case against your Wife under the concerned provisions of law for indulging in Adultery and getting married without seeking Divorce from you. Adultery is no longer a Criminal Offence, but marrying a second woman without seeking Divorce from first is illegal and punishable.

Yes, you can file a case of Bigamy against your Wife, as you have got a Documentary Evidence with you in the form of a FIR, where it has been depicted that your Wife has married him and without Divorcing him, married you.
