wife asking maintenance while we separated from mutual consent.....

हमारी शादी के एक दिन बाद ही रीति रिवाज से हुई अनबन की वजह से मेरी पत्नी को वापिस मायके ले गए थे...सामाजिक बैठक में पत्नी ने कहा कि अभी वापस नही जाऊंगी 1 साल सोचने के लिए समय चाहिए... पति ने भी उसके फैसले को मान लिया....अब 1 साल के बाद एक maintance का case की है....आपसी सहमति से अलग रह रहे हैं तो....क्या मुझे maintance देना पड़ेगा....सिर्फ एक दिन थी मेरे घर में... घूंघट भी उठा के नही देखा था

If the behaviour of your partner is intolerable towards you but you still want to continue the matrimonial life with her then you can always file a petition under section 9 HMA. And if there's no scope of living together then rather stretching the relationship you should file for divorce under cruelty grounds and even go with mutual divorce because it's cost effective and ends up in a maximum of six months.

U need to hire expert advocate in this regard. She is legally your wife and now need to check the facts on eligibility of maintenance. We need to check whether she is eligible for maintenance or not and the same contention we have to put in court Thanks

it depends on situations. I think you must take help of RCR9. it is better that you do settlement to some amount as monthly maintenance will never leads to an end of the result, even then you have to settle to some amount.
