Wife asking for money and threatening to hit and abusing on phone

I and my wife are living separated from last one year. She has abusive nature n has bad behaviour against my mother. she has taken all jewelries before leaving home. She does not want to continue.So finally i approached for Mutual consent. Now just before starts proceedings she demands 10 lakhs rs.She has few belongings like her few cloths N wedding gift. she called me up one day.& asked for things. I refused with saying that as i don't trust her & will return her belongings in front of her parents or brother. then she threatens to hit me & abuse on phone. we have NC against each other. Now its one year she is not even contested for divorce.Please advise me on this

I would suggest you to approach her calmly and make her understand that there is no point in continuing the relationship forcibly unwillingly and as even the judicial separation period of one year is over you can request the court to pass a decree as you wish to have a better future n concentrate on bright future

This is my response to you:
1. File an FIR against her before she does against you;
2. Say she stole the jewelry and theft has happened;
3. Also state that she abused you and attempted to cause grievous hurt against you;
4. Play pressure tactics on her and make her agree for mutual consent;
5. Tell her that is the only way you will drop the FIR charges;
6. Last step, before she approaches the court you should file contested divorce petition in the court.

in this case you can file a divorce case against her and issue summons to her and proceed with the matter in the mean time if matter settles and she gets ready for mutual consent divorce then you can immediately convert the said case to mutual consent divorce

Hi Dear Querist, as per your query you have mentioned that it has been a year she has not contested for divorce, therefore you are advised to take step from your side and file your divorce under grounds for Cruelty by collecting evidence like recording her threatening phone calls etc. so it can help you to prove the same before the court.

If you both are Hindus/Christian you can file one sided divorce on grounds of cruelty if she is not agreeing for mutual consent divorce.All articles to be returned can be handed over in court at appropriate juncture .I assume that in the NC you have mentioned that she left with all her valuables. You can also send her a legal notice for a mutual consent divorce .
