In a contested divorce case, the list of witnesses should be presented before or at the time of filing the evidence affidavit, not during cross-examination. As per Order XVI Rule 1 of the Code of Civil Procedure (CPC) the list of witnesses should be filed prior to the commencement of the trial, usually along with the evidence affidavit of the party.

In most legal systems, a list of witnesses is typically presented to the court before the commencement of the evidence stage, specifically within a timeframe set by the court after the issues in the case have been decided. This allows the opposing party and the court to prepare for the examination of witnesses and ensures an orderly presentation of evidence.

The list of witness has to be filed before filing the affidavit of evidence of the Complainant. However, different courts may follow different procedures for filing list of witness, but ideally the list of witness has to be annexed with the divorce petition itself, so that the opp side must also be aware as to which witnesses you are going to call for your case in future. in case you require any further legal assistance you may contact me.
